What is a Family-Based Petition?

A family-based petition is a process that allows a U.S. citizen or lawful permanent resident (green card holder) to request that certain qualifying family members receive lawful immigration status in the United States.

The purpose is to keep families together by allowing eligible relatives to immigrate or adjust their status through a recognized family relationship.

The process begins with filing Form I-130 (Petition for Alien Relative) with U.S. Citizenship and Immigration Services.

Who Can Be Petitioned?

U.S. Citizens may petition for:

  • Spouse
  • Unmarried children (under 21)
  • Unmarried sons and daughters (21 or older)
  • Married sons and daughters
  • Parents
  • Brothers and sisters

Lawful Permanent Residents may petition for:

  • Spouse
  • Unmarried children (under 21)
  • Unmarried sons and daughters (21 or older)
